Chapter 7 Bankruptcy

Chapter 7 bankruptcy is a useful tool for people facing overwhelming credit card or medical debt that has arisen from circumstances often out of their control such as job loss, illness or divorce. Chapter 7 provides consumers a fresh start, offering relief from most unsecured debts. Once I file the Chapter 7 bankruptcy petition on your behalf, all creditor collection activity must stop, and any communications from them must go to me instead.

We will discuss your financial situation, and I will gather necessary information about your debts, assets and creditors. If you qualify for Chapter 7, I will then file your petition. Thirty days later, you will be required to attend the meeting of creditors, and I will be with you at that meeting. You will also begin to attend credit counseling classes required by the court. In most cases, the court will discharge your debts 2 to 3 months after the creditors' meeting.

Chapter 13 allows individuals to get the breathing room they need to catch up on their debt obligations.

Chapter 13 bankruptcy restructures your debts into a payment plan that allows you to pay back some or all of your debt over a period of 30 to 60 months. The payment plan is tied to your ability to pay. It will take into account your income minus expense obligations such as food, transportation, utilities and health insurance.
